GOVERNOR SISOLAK HAS ISSUED A MORATORIUM ON EVICTION THROUGHOUT THE ENTIRE STATE OF NEVADA.

WHAT DOES THIS MEAN?

  • YOU CANNOT SERVE ANY NOTICES TO TENANTS AND CANNOT FILE A SUMMARY EVICTION UNTIL THE MORATORIUM HAS BEEN LIFTED. THIS IS IN EFFECT FOR THE DURATION OF THE STATE OF EMERGENCY (LIKELY 90 DAYS)
  • THERE IS ONE EXCEPTION: DANGEROUS TENANTS
  • THIS APPLIES TO RESIDENTIAL AND COMMERCIAL PROPERTIES 
  • YOU CANNOT CHARGE TENANTS LATE FEES DURING THIS PERIOD  
  • ANY CONTRACT BETWEEN LANDLORD AND TENANT REMAIN IN EFFECT. LANDLORDS ARE STILL RESPONSIBLE FOR REPAIRS, ETC. TENANT ARE STILL RESPONSIBLE FOR THEIR DUTIES OUTLINED IN CONTRACT. 
  • LANDLORDS AND TENANTS ARE URGED TO COME TO AN AGREEMENT TO ARRANGE PAYMENT PLANS. THIS IS NOT RENT FORGIVENESS.

SEVEN-DAY NOTICE OF EVICTION FOR NON-PAYMENT OF RENT (NRS 40.253)

Is your tenant is late on their rent payment? Please submit your request for Battle Born Process Service to prepare and serve your 7-Day Notice for Non-Payment of Rent. 

FIVE-DAY NOTICE TO PERFORM LEASE CONDITION OR QUIT (NRS 40.2516)

Has your tenant(s) neglected or failed to perform a condition or covenant of your lease or rental agreement? We can prepare a Five-Day Notice to Perform Lease Condition. You will need to describe in detail the lease violation(s) alleged, with citation to each applicable page and paragraph of lease).

**** IF TENANT DOES NOT CORRECT VIOLATIONS OR VACATE, THIS NOTICE MUST BE FOLLOWED UP WITH A 5-DAY UNLAWFUL DETAINER NOTICE ****

THREE-DAY NOTICE TO QUIT FOR NUISANCE, WASTE, ASSIGNING/SUBLETTING, UNLAWFUL BUSINESS, OR DRUG VIOL.

 THREE-DAY NOTICE TO QUIT FOR NUISANCE, WASTE, ASSIGNING/SUBLETTING, UNLAWFUL BUSINESS, OR DRUG VIOLATION (NRS 40.2514) 


This notice advises the tenant that they must vacate the premises within three (3) judicial days after the Date of Service of this notice for the following reason(s) (any/all that apply): 

  •  Assigning or subletting the premises contrary to the covenant of the lease; 
  •  Committing or permitting waste on the property; 
  •  Setting up or carrying on any unlawful business in or on the property; 
  •  Suffering, permitting, or maintaining a nuisance on or about the premises consisting of conduct or an ongoing condition which constitutes an unreasonable obstruction to the free use of property and causes injury and damage to other tenants or occupants of that property or adjacent buildings or structures; 
  •  Violating any of the controlled substance laws contained in NRS 453.011 to NRS 453.552, inclusive, except NRS 453.336, in or on the property. This notice is based upon the following facts (describe in detail the facts and circumstances relating to each box checked above, including names, dates, locations, etc.;

FIVE-DAY NOTICE TO QUIT FOR UNLAWFUL DETAINER OTHER THAN NON-PAYMENT OF RENT (NRS 40.254)

When a tenant does not remedy a 5-Day Perform Lease Notice, 30-Day No-Cause Notice, or 3-Day Notice, you must proceed with serving a 5-Day Unlawful Detainer Notice. Once the 5 days expires and the tenant still has not remedied notice or vacated the premises, you can proceed with the summary eviction filing (lockout) in the Justice Court. Once documents are filed and delivered to the Sheriff, the Sheriff will proceed with the lockout process. For more information, please click HERE. 

WHAT HAPPENS WHEN TENANT DOES NOT REMEDY NOTICE OR VACATE THE PREMISES?

If your tenant does not remedy the notice or vacate the premises, you can proceed with the summary-eviction process (lockout) by filing the Affidavit of Landlord and supporting documents at the Justice Court. Once the lockout is filed, we proceed with delivering a filed copy and fee to the Sheriff's Office. The Sheriff will contact the Landlord or Landlord's Representative before the lockout. Battle Born Process Service can assist you with this process from start to finish.  Please submit your request for Battle Born Process Service to prepare your Affidavit of Landlord. We will email you the completed Affidavit of Landlord for your review and signature. We will NOT need originals for courts in Reno, Sparks, Las Vegas, and Henderson. You can sign, scan and email a copy to our office. We will need to arrange to get the original from you for any other court in Nevada.

 Once the Constable receives the order from court, the eviction notice will be posted the next business day and the Constable will lockout the property the following business day. On the day of the lockout, the deputy will contact you no later than 11:00 am to schedule the lock change.
